Kristen Smith is an expert in international trade with over 20 years of experience in trade remedies, customs, and compliance. Having worked both at the U.S. Department of Commerce and International Trade Commission, Ms. Smith provides clients creative solutions to difficult trade issues and insight on how to mitigate potential duty liability and risk. She has saved clients millions of dollars with money-savings strategies including section 232 and 301 exclusions.
Expertise in Trade Remedies: Ms. Smith has a proven track record of fighting antidumping and countervailing duty issues before the U.S. Department of Commerce and the International Trade Commission where she has obtained numerous negative determinations, out of scope determinations and de minimis duty rates including a negative determination on behalf of the government of Sri Lankan in the countervailing duty investigation on certain new pneumatic off-the road tires. She has participated in over 100 trade remedy proceedings involving industries such as wood products, flooring, cabinets, furniture, automotive, bearings, aluminum, steel, seafood, agriculture, solar, mattresses, textiles, building products, retail, household appliances and chemicals.
Customs and Compliance: A licensed customs broker, Ms. Smith routinely represents clients in matters before U.S. Customs and Border Protection (CBP) including successfully fighting evasion allegations under the Enforce and Protect Act (EAPA) on behalf of an importer of aluminum products. Ms. Smith also assists corporations to proactively protect against potential duty liability including helping clients navigate complex antidumping and countervailing duty anticircumvention certification programs resulting in substantial duty savings. Her understanding of complex supply chains and knowledge of documentation required by government agencies allows her to assist clients in crafting compliance programs that protect against unexpected duty liability and government investigations. Ms. Smith has successfully assisted clients in CBP audits and investigations.
Litigation: Ms. Smith represents clients before the U.S. Court of International Trade and U.S. Court of Appeals for the Federal Circuit. Her litigation successes have saved clients millions of dollars in duty liability. Ms. Smith has been appointed to the Court of International Trade Rules Advisory Committee which is tasked with making recommendations to improve the CIT rules and procedures.
